It is right there on page 5 of the Tory Party’s 2019 Manifesto:

“We will keep the UK out of the Single Market, out of any form of Customs Union, and end the role of the European Court of Justice.”

Instead a role for the EU’s Court as continued, with the likes of Lord Frost having to argue that the ECJ’s role must finally be scrapped when it comes to the Northern Ireland Protocol.

The removal of ECJ has been a key demand from Brexiteers for a while now. This is an obvious requirement for anyone who truly believes in ‘Getting Brexit Done’.

It is also logical for Leavers to be sceptical as to whether the Government will stand firm on this or not.

When he was Brexit Minister, Lord Frost made it clear that removing ECJ jurisdiction was a red line for the Government.

That very quickly turned into disturbing briefings that the Government were pretty much ready to cave in and surrender on this.

An absurd amount of time has now passed with the Government failing to trigger Article 16 and then Rishi Sunak’s Government seemingly shelving the Protocol Bill that would have made sensible unilateral changes.

Instead, an endless talking shop has ensued with various joint statements from the UK and EU promising yet more discussions.

Now a Deal being done looks pretty much inevitable. And there are serious concerns that a complete capitulation could be about to take place.
